Welcome to the Argus Advisory Global Cards and Payments Research website (the "Website"), a subscriber-only service providing to customers research facilities for market and competitor intelligence on payment cards, e-money, acquiring and processing, retail banking and consumer credit, including an interactive online "Cards and Payments Research Database" containing detailed data and analysis of the global cards and payments industry, together with country reports assessing the banking market across multiple consumer products, and regional reports with respect to merchant acquiring, retail banking and credit card profitability (the foregoing collectively the "Services"), sponsored and supported by TransUnion and its affiliates, trading as Argus Information and Advisory Services ("Argus"). You are being provided access to this Website and Services pursuant and subject to a subscription agreement that either your company has, or you have, entered into with Argus (the "Subscription Agreement"). Argus requires that all visitors to the Website and users of the Services adhere to certain terms of use, as elaborated in this statement (the "Statement"). Please read it carefully. By accessing the Website and using the Services, you indicate that you acknowledge and accept them.
You are expected to be knowledgeable about the rights and obligations set forth in the Subscription Agreement, including without limitation the use rights you have in and to the data and information in the Website. You will comply with the terms of the Subscription Agreement and this Statement (collectively the "Customer Contract"), and all laws, rules and regulations applicable to your use of the Website and Services. Your actions and inactions in breach of the rights and obligations in the Customer Contract may give rise to a legal claim by Argus against you and/or your company. For the avoidance of doubt, you have no rights independent of the Customer Contract.
Your account is personal to you. Thus you shall ensure you will not share any access privileges to the Website and/or Services with any unauthorized party, and shall treat the password you use to access the Website as your personal confidential information and not disclose it to any other person or party. You are responsible for all activities that occur under your account, regardless of whether the activities are authorized by you or undertaken by you, your employer or a third party (including contractors, agents or end users). Argus is not responsible for unauthorized access to your account (other than as caused by its negligence). If you become aware of any unauthorized access or use, you will promptly notify Argus, and immediately change your password. Argus will have the right to suspend access should it suspect or become aware of any breach of the Customer Contract and/or security risk to the Website.
